PERMISSIONS; CONTENT. In the absence of a License Agreement that accompanies the Software, use of the Software will be governed by the Terms of Use.

In no event shall IDS be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use of this Web site, use or performance of documents, publications, software, provision of or failure to provide services, or information available from the Web site.

Privacy Policy
International Decision Systems, Inc. is committed to maintaining the trust and confidence of its customers and Web site visitors, as well as the security of all data collected. IDS stores information in a controlled, secure environment. We respect the rights you give us when opting to receive e-mail communications and we enforce policies to preserve those rights. It is our objective to retain good, long-term relations with our customers.
We may ask you to provide personal information and preferences when you visit certain areas of idsgrp.com, download free software, request information, or subscribe to our publications. All forms of electronic communication will be made available on an opt-in basis. You may opt-out of such communication at any time.
Personal information you supply will be used only for communication between you and IDS for business purposes, in accordance with your stated preferences. IDS and IDS representatives may use the information to alert you to upgrades, classes and other information. (‘Representatives’ include authorized training partners.) We occasionally hire other companies to provide limited services on our behalf, such as processing event registration. We will provide those companies only the information they need to deliver the service, and they are prohibited from using that information for any other purpose. IDS will not sell, distribute or share information about you with any other third party.
If a visitor elects to use our ‘Email this article’ application to forward IDS Web site content to a colleague, we ask them for the colleague’s name and e-mail address. IDS will send the specified e-mail or Web site information automatically. IDS will not use the colleague’s information to contact them in the future.
Though we make every effort to preserve visitor privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on our Web site.
CLIENT SUPPORT. IDS offers secure access to its client support knowledge base (‘Client Support’). Access and registration is administered by a password administrator within the customer organization. This information is stored and protected by the Client Support user ID and password.
LOG FILES. A log file (‘cookie’) is a small line of text that is stored with your Web browser for record-keeping purposes. Your browser has options to accept, reject, or provide you with notice when a cookie is sent.
IDS uses visitor log files with the Web site. Once a visitor enters our site, a cookie follows them through their click stream path. Examples of information being collected by these cookies include the number of times a visitor came to our site(s), and the paths they took to get there. IDS uses the data collected in aggregate form only and does not collect any personally identifiable information. Use of this information helps us better understand what visitors are seeking and learning at our Web site(s) and helps us improve the site.
LINKS. The Web site may contain links to other sites. IDS assumes no responsibility for the content or privacy policies and practices of such Web sites; their practices may differ from ours.
COMMENTS & QUESTIONS. Please share comments or questions regarding the IDS privacy policy with your password administrator or IDS technical support. We may occasionally update, amend, or change this policy. If we decide to change our privacy policy, we will post those changes to this statement, and will e-mail the information to our customers so that they are always aware of the information we collect, how we use it, and under what circumstances, if any, we disclose it. Visitors always will have a choice as to whether we use their information in accordance and with respect to the posted privacy policy or the one under which information was collected. If visitors have opted out of all communication with the site, they will not be contacted.
Security
IDS expects that you will provide true, current, complete and accurate information as prompted by any registration form. You are responsible for maintaining the confidentiality of passwords and user names. Furthermore, you are responsible for any and all activities that occur under your user name. You agree to notify your password administrator immediately of unauthorized use or any other breach of security. IDS will not be liable for any loss an organization may incur as a result of someone else using a password or account, either with or without your knowledge. However, you could be held liable for losses incurred by IDS or another party due to unauthorized use. You may not use anyone else’s user name and password at any time. You acknowledge and agree that certain services may provide password-restricted access to information such as software documentation and training materials. By using this Web site and registering for such services, you consent to IDS’ display of such information via the services and accept all risks of unauthorized access. If you knowingly provide, or your password administrator or IDS has reasonable grounds to suspect you have provided false, inaccurate, out-of-date, or incomplete information, IDS and/or your password administrator may suspend or terminate use of such services.
You will not use this Web site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use Web site services in any manner that could damage, disable, overburden, or impair any IDS server, or the network(s) connected to any IDS server, or interfere with any other party’s use and enjoyment of the Web site. You may not attempt to gain unauthorized access to services, other accounts, computer systems or networks connected to any IDS server or to the Web site, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Web site.
Code of Conduct
The Web site may contain messaging facilities designed to enable you to communicate with others (‘Communication Services’). You agree to use Communication Services only to post, send and receive related messages and material. By way of example, and not as a limitation, you agree that when using the Communication Services or the Web site, you will not:
- Harvest or otherwise collect and provide to others, personal information including e-mail addresses and user directories.
- Defame, abuse, harass, threaten or otherwise violate the legal rights of others.

- Advertise, offer to sell or buy goods or services, or transmit unsolicited or bulk communications to any IDS account holder or idsgrp.com or affiliated email address (regardless of whether you use Communication Services or the Web site to transmit any such communication).
- Use any IDS domain name as a pseudonymous return e-mail address for any communications that you transmit from another location or through another service.
IDS has no obligation to monitor Communication Services. However, IDS reserves the right to review posted materials, to remove and/or edit them, or to disclose information as necessary to satisfy applicable laws, regulations, legal processes or government requests. Uploaded materials may be subject to posted limitations on use, reproduction and/or dissemination; you are responsible for adhering to them. IDS does not control or endorse the content of any Communication Service; therefore, IDS specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation. Managers and hosts are not authorized IDS spokespersons, and their views do not necessarily reflect those of IDS.
Submissions
Unless specified, IDS does not claim ownership of the materials (including information, ideas, concepts, techniques, feedback, data, questions, comments and suggestions) submitted for review by IDS and/or the members of any community (each a ‘Submission’ and collectively ‘Submissions’). By posting, uploading, or submitting (‘Posting’) your Submission you are granting IDS, its affiliated companies and necessary sub-licensees permission to use your Submission in connection with the operation of their and/or IDS’ businesses.
Postings will be considered non-confidential and non-proprietary, meaning you grant others license rights to: copy, distribute, transmit, reproduce, edit, modify, translate and reformat your Submissions; publish your name in connection with your Submission; develop, manufacture, and market products incorporating such ideas, concepts, or techniques, and the right to sublicense such rights. No compensation will be paid and IDS is under no obligation to post or use a Submission. At its sole discretion, IDS may remove a Submission at any time.
You understand that all Submissions, whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Submissions originated. This means that you, and not IDS, are entirely responsible for all Submissions that you post or otherwise transmit via the Web site. You warrant and represent that you own or otherwise control all of the rights to your posted Submission as described in these Terms of Use.
You agree to indemnify, defend and hold IDS, and its subsidiaries, affiliates, officers, agents, co-branders, partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your Submissions, you and your employees’ use of the Web site, your connection to the Web site, your violation of the Terms of Use or of any rights of another.
Terms of Use
The Terms of Use currently posted constitute the entire agreement between you and IDS and supersedes any prior agreements. You may be subject to additional terms and conditions when you use other IDS services or software. You may not assign or otherwise transfer this agreement.
Minnesota law and controlling U.S. federal law govern any action related to this document, without regard to the principles of choice of law. The parties specifically disclaim the U.N. Convention on Contracts for the International Sale of Goods.
IDS controls and operates this Web site from its headquarters in the United States of America and makes no representation that this Web site is appropriate or available for use in other locations. If you use this Web site from other locations, you are responsible for compliance with applicable local laws.
You acknowledge and agree that material on this Web site is subject to U.S. Export Administration Laws and Regulations. Diversion of such material contrary to U.S. law is prohibited. You agree that none of the material on this Web site, nor any direct product therefrom, is being or will be acquired for, shipped, transferred, or re-exported, directly or indirectly, to proscribed or embargoed countries or their nationals, nor be used for nuclear activities, chemical biological weapons, or missile projects unless authorized by the U.S. Government.
